A LEGAL APPRAISAL OF THE BOKO HARAM INSURGENCY IN NIGERIA

Abstract

This research legally appraises the Boko Haram insurgency in Nigeria. The state of insecurity engendered by Boko Haram insurgency in Nigeria, especially in the North-Eastern part of the country is quite worrisome and alarming. Terrorist attacks of the Boko Haram sect have resulted in the killing of countless number of innocent people and wanton destruction of properties through bombings. More worrisome however, is the fact that all the efforts of the Nigerian government to curtail the activities of the sect have not yielded any meaningful positive result. Thus, the Boko Haram scourge remains intractable to the government who appears helpless in curtaining/curbing their activities. The dynamic and sophistication of the Boko Haram operations have raised fundamental questions about national security, governance issues and Nigeria�s corporate existence. The research investigates the Boko Haram insurgency in Nigeria and underscores the urgent need for a permanent resolution of the crisis. The research also points out most of the circumstances that led to this insurgency and also elaborates on the apparent effects on the nation. Also considering the effects of this insurgency, this research further discusses the applicability of Nigerian criminal laws on the Boko Haram insurgency.� The research recommends among others, the necessity to address poverty reduction, religious secularism and political re-orientation.� The work however concludes Boko Haram insurgency in Nigeria is clearly an act of terrorism against the Nigerian State; one which in that effect puts the conflict under the authority of the Nigerian State to act using the Criminal Laws of the State.
