AN OVERVIEW OF RULE OF LAW AND ITS RELEVANCE TO HUMAN RIGHTS IN NIGERIA

Abstract

This research work examines the concept of human rights and her protection in the Nigerian society, in addition to its violation in both military and civilian dispensations of Nigerian governance. In addition, the research looks at the role of the judiciary in the protection of the fundamental human rights of Nigerian citizens. This research further sheds light on the principle of the rule of law as an essential instrument of democracy. It discusses this principle, describing its nature as well as its elements in addition to the role which the judiciary plays in the advancement this principle and the challenges this arm of government has faced in her strife for its total application in Nigeria. This research concludes that the principle of rule of law must be in existence and adhered to at all times in any society which aims for a holistic development, of which Nigeria is no exemption. In addition, all should be put in place to aid the constant upholding of this principle, invariably adding the protection of the human rights of all and finally recommends. This research recommends that the judiciary should be supported by all to uphold the principle of rule of law and protection of the human rights of Nigerians. In addition, she would be supported in achieving the above goals if she is totally independent in all her dealings, and the other arms aid in setting up real implementation mechanisms to aid adherence to court orders and judgments.
