AN EXAMINATION OF LEGITIMACY AND LEGITIMATION OF A CHILD IN NIGERIA

Abstract

This research work examines the legitimacy and legitimation of a child in the Nigerian society. This research adopts the doctrinal method of research and employs the use of primary and secondary sources such as text books, journals, statutes, online sources, case laws, e.t.c. with the aim of deciphering the act of legitimacy and legitimation of a child. This study finds that children born outside lawful marriages are often stigmatized and face social and legal discrimination. Legitimation is the process of giving legal recognition to a child born outside marriage, while legitimacy refers to the social acceptance of a child�s birth status. The study further finds that though there are laws such as the Constitution of the Federal Republic of Nigeria, e.t.c, prevents the discrimination of a child by reason of his birth, stigmatization still exists in the society. This research therefore recommends that the government amongst others conduct enlightenment campaigns against discrimination and stigmatization of children by reason of their birth as well as ensure the prosecution of persons who engage in such nefarious acts to serve as a deterrent. This study thus concludes that children are to be protected, loved and cared for by their parents, guardians and the society. Thus the act of discrimination of a child by the reason of his birth must be abhorred.
