AN ANALYSIS ON THE FREEDOM OF INFORMATION ACT 2011 AND ITS IMPORTANCE IN THE NIGERIAN DEMOCRACY

Abstract

Freedom of information is a fundamental right which is part and parcel of a well developed and functional democratic process. This study examines the multiple problems which plague the Act that enables access to information in Nigeria, especially in relation to the implementation as multiple organizations have found different ways to frustrate the intendment of the act by challenging the locus standi of the requester, delaying to provide the requested information or disobeying the act which frustrates the entire process of obtaining information. This has created the need to fix these problems. This study also examines the methods in which other jurisdictions implement and tackle these problems associated with the fundamental right of freedom of information. This study proffers solutions which may aid in the solving of these problems which are associated with the Act and its implementation by suggesting solutions in respect to the compliance, implementation and education of citizens as to the rights they have been guaranteed under the act to achieve Freedom of Information in Nigeria. This study recommends that the judiciary can also help by displaying courage and activism, the government should make an effort to teach the people about their rights and the people should be willing to learn and change from the past practices which prevented access to information. This study concludes that if all these are taken into consideration, and worked upon, and then Nigeria is bound to see an improvement in quality of life as the government would be accountable and the people will benefit from it.
