AN EXAMINATION OF THE PRINCIPLE OF RULE OF LAW IN CONTEMPORARY NIGERIA

Abstract

This research examines the applicability of the principle of rule of law in contemporary Nigeria. The extent to which the principle has served as a yardstick in the functioning of the nation as a whole. The research investigates the various limitations as well as the prospects in the application of the principle in Nigeria. The rule of law is expected to be the guiding principle of governance since it is the foundation of good governance. The experience in Nigeria is to the contrary as successive administrations in the country often violated the principle in their actions. Thus this research examines how the principle has been adopted as a tool in the hands of various administrations in Nigeria, using doctrinal and analytical synthesis of events. The work however concludes that unless the political leadership within the nation views itself as a creation of the law and must thus be guided by the law, the rule of law would continue to deteriorate. Also, the rule of law thrives in a totally democratic society where the fundamental human rights of individuals are upheld and the actions of the government is in line with the law and finally recommends that the government should uphold the rule of law in their actions and they should be accountable, open and responsible at all tiers and levels in Nigeria.The fundamental human rights as guaranteed by the Constitution should be respected at all times in order for the rule of law to be fully established.
