ANALYSIS OF THE APPLICABILITY OF INTERNATIONAL HUMANITARIAN LAW AND CHALLENGES OF CONTEMPORARY ARMED CONFLICT
Abstract
This research work examines the extent of the application of international humanitarian law in times of armed conflicts in regulating the conduct of hostilities. This research discovers the egregious effect or challenges facing the applicability of international humanitarian law to contemporary armed conflicts and the devastating effects or impact they have on the civilian population, the environment, human resources of the State and the economic. This research also talks about the protective scope of IHL in rendering humanitarian assistance in international armed conflict and in non-international armed conflict, the regulation on the means and method of warfare, observance of the principle of IHL, protection of the environment in times of armed conflict, application of Additional Protocol I and ENMOD Convention in protecting the environment, the effects of biological, chemical, nuclear and incendiary weapons. In addition to the mechanisms for the review of the legality of means and method of warfare. Therefore, this research recommends that there should be a total respect of rules of war and more restraining interpretations of what the fundamental principles of distinction, proportionality and precaution actually mean. Finally, this work concludes that concerted effort, particularly in the area of applicability of IHL in times of armed conflicts and respect for its principles should be adopted.
