AN EXAMINATION OF THE LEGAL FRAMEWORK ON THE PREVENTION AND CONTROL OF NARCOTIC DRUGS AND PSYCHOTROPIC SUBSTANCES IN NIGERIA

Abstract

As a result of the rising issue of illicit drug activities in the world, various laws have been enacted in an effort to regulate the production, import, export and� sale of illicit drugs. This research therefore examines the drug laws that have been enacted in Nigeria flowing from the domestication of some international drug laws. This research also examines the institutions are charged with the responsibility of implementing these drug laws in Nigeria, as well as the challenges faced with the implementation of these laws. This research employed the doctrinal method of research where case laws, books, newspapers, statutes and conventions as well as internet sources were cited. This research finds that various drug laws have been enacted in Nigeria. This research observes that despite the provision for rehabilitation in the International Conventions which Nigeria has domesticated, the NDLEA Act still regards drug offenders as criminals and not victims, thereby making provision for the punishment of drug offenders. Also, there is a stigma attached to drug addicts which makes rehabilitation difficult. This research recommends that the public should be enlightened on the issue of illicit drug activities, rehabilitation centers should be established for treating drug users. Narcotic drugs and Psychotropic substances are illicit drugs and have been prohibited by drug laws both local and international. Drug trafficking and drug abuse is one of Nigeria�s major issues today, therefore proper efforts should be made to curb the issue of illicit drugs and international intervention is also permitted.
