A COMPARATIVE ANALYSIS OF THE CONFLICT BETWEEN THE CRIMINAL CODE AND THE PENAL CODE ON THE RIGHTS OF WOMEN IN NIGERIA

Abstract

This research examines the conflict between the criminal code and the penal code on the rights of women in Nigeria. Utilizing a primarily doctrinal approach methodology, it draws from various primary sources such as the Nigerian Constitution and the two major penal legislations in Nigeria; the Criminal Code and the Penal Code which are the main focus of this work. It also sources from secondary references like textbooks, articles, journals, websites and newspapers. The study finds that despite the provisions of the Constitution of Nigeria against discrimination, the Criminal and Penal code have incongruous provisions that hamper on the rights of women; providing varying standards of protection to women which is largely dependent on the geographical area which they find themselves. The study advocates for a reformation of Nigeria�s Penal legislations. Importantly, it advocates for the adoption and domestication of international treaties which better protect the rights of women in Nigeria. Ultimately, this research stresses the protection afforded to women in Nigeria and the need to augment this protection for a sustainable and equitable society.
