AN EXAMINATION OF THE ROLES AND RESPONSIBILITIES OF AN EMPLOYER UNDER CONTRACT OF EMPLOYMENT
Abstract
ABSTRACT This research investigates the legal framework governing employer responsibilities under employment contracts in Nigeria, emphasizing common law, statutory mandates, and international conventions. This research aims to address the historical imbalance favoring employers, clarifying the rights and duties of both parties in the employment relationship. The research employs doctrinal research methodology, examining legal principles, statutory laws such as the Labour Act and Factories Act, and international standards from the International Labour Organization (ILO). Findings indicate that employers have substantial obligations to ensure workplace safety, provide adequate tools, systems of work, and competent staff, as established in key legal cases. Statutory duties impose strict liabilities on employers for ensuring employee welfare and safe working conditions, while international conventions highlight discrepancies between Nigerian practices and global standards, especially regarding fair dismissal practices. This research reveals a need for ongoing legal education to empower employees to challenge unlawful employer actions. Recommendations advocate for legal reforms to balance employer and employee rights, strengthen statutory protections, and align Nigerian labor practices with international standards. The research concludes that there is a need for a comprehensive reforms in labor law and practice to create a fair and equitable employment environment, protect employee welfare, and hold employers accountable.
