AN EXAMINATION OF THE LEGAL FRAMEWORK FOR COMBATING CYBERCRIME IN NIGERIA

Abstract

This research examines the effectiveness of the current cybercrime laws in Nigeria with reference to the 2015 Cybercrime Act. This work clearly discusses the nature, causes and effect of cybercrime in Nigeria, and posits that cybercrime is continually evolving with the emergence of new technology. Therefore new machineries have to be put in place to enforce the already existing legislations. Furthermore, it discovers that although there is a Cyber Crime Act in Nigeria the potency of it to accommodate this new trend is in doubt. This research reviews various statutes like the EFCC Act, Cyber Crime Act and others, and discovers the loop holes with respect to Cyber Crimes. It also recommends a review of the current Cyber Crimes Act and the criminal Justice system. This research concludes that the population is becoming increasingly refined in their understanding and use of computers and there is a string possibility that Cybercrimes will be more common. This research draws the attention of law makers to review the relevant laws and make new ones to beat the trend and put an end to this Cyber Crime menace in Nigeria. The present legislation on cybercrime in Nigeria is inadequate and inefficient as cybercrime is a continuous menace and has contributed negatively to the country�s economic sector, thereby bringing disrepute to the country�s image and its citizens in the eyes of the world .
