AN ANALYSIS OF THE LEGAL FRAMEWORK PROHIBITING CHILD MARRIAGE IN NIGERIA.

Abstract

This research work examines the legal framework prohibiting child marriage in Nigeria . The practice of child marriage is one paralytic custom that needs a light to be cast on it to expose the dullness of our nation�s legal system. The views of philosophers, erudite scholars, jurists and other notable researchers are taken into account in arriving at a practical remedy for the victims which in most cases are the girl child. A survey to measure exactly how wide this heinous practice have spread is reported in this work and a special attention is called to the northern region of Nigeria where it is most prevalent. This project discusses the concept, consequences and causes of child marriages in Nigeria such as poverty, illiteracy, insecurity societal pressure, religious influence and the like. The work further makes a comparative analysis of current position in Nigeria as regards the effectiveness of laws relating to child�s marriage and finds that the mere existence of the laws are not enough, but it�s ratification by all states in Nigeria will make more sense. Based on the finding of this study, it recommends that the Government makes it so that its political will bends towards the implementation/enforcement laws that discourages child marriage by first domesticating it.The research concludes that the enlightenment this research work brings is key in changing the attitude in those communities in Nigeria where the practice is still deep rooted. If this can be achieved then Nigeria will be a better place for young girls to live without a fear of being forced into early marriage.
