Abstract

This research examines the challenges against the effective prosecution of sexual violence in Nigeria. The issue of sexual violence is a serious challenge in Nigeria due to the increasing rate of the menace, making it a cause for concern for Government, Non-Governmental Organizations, and citizens to put forward measures to curb this menace. This research achieves it�s analysis through a critical look at literature works where experts discuss the subject matter extensively. This research examines the nature and forms of sexual violence that exists in Nigeria and subsequently articulates it�s spread in the country. This research further interrogates the existing legal framework and discovers that there are gaps existing in the current framework. This research reveals that the Violence Against Persons (Prohibition) Act, 2015 is a laudable development which captures emerging issues on the subject matter. This research addresses the process of prosecuting sexual offences in the Nigerian criminal justice system which comprises of the police, the judiciary and prison and subsequently, submits that the enforcement mechanisms are not effective. This research also articulates the reasons for the inability of the effective prosecution of sexual violence in Nigeria by revealing certain challenges that exists within the system with a view of making suggestions to help move the country forward and curb the violence. This research therefore recommends and concludes that a multi-dimensional approach should be adopted which includes but not limited to the health sectors, government, mass media and the community in addition to review of laws .
