THE CRITICAL EVALUATION OF THE APPLICATION OF INTERNATIONAL HUMANITARIAN LAW (IHL)

Abstract

This study critically appraised the application of International Humanitarian Law (IHL) rules governing attacks on plants containing dangerous substances during the Russian-Ukraine war. The research aimed to assess the effectiveness of these rules and identify the enforcement challenges encountered.�Through a�qualitative approach�, including doctrinal analysis and desk-based research, the study examined relevant literature, analyzed case studies from the Russian-Ukraine war, and explored the difficulties in enforcing IHL regulations.�The findings highlighted the importance of addressing the application of IHL rules in protecting plants with dangerous substances. The study identified challenges in determining responsibility, acquiring evidence, establishing jurisdiction, and the role of international organizations and tribunals. These enforcement challenges had wider implications for IHL's ability to safeguard critical infrastructure and minimize harm to civilians.�In conclusion, this research emphasized the need for comprehensive strategies to improve the enforcement of IHL rules governing attacks on plants containing dangerous substances. Recommendations were provided to strengthen enforcement mechanisms and to further enhance IHL frameworks in armed conflicts involving such facilities. The study contributed to the ongoing discourse on safeguarding vital infrastructure and upholding humanitarian principles during armed conflicts, addressing the specific context of the Russian-Ukraine war. � �
