UNFAIR PRACTICES IN LABOUR RELATION: THE PLACE OF THE EMPLOYEE

Abstract

This research examines unfair practices in labour relation, with emphasis on the place of the employee. The study adopts the use of the doctrinal research method and reviews case laws, journal articles, statutes, websites related to the subject and finds that Nigerian employees face various unfair labour practices which include wrongful termination of employee contract of employment, casualization of workers, discrimination at workplace, sexual harassment, discrimination against persons with disabilities, and anti-unionism policy. The study finds that despite the provisions of protection afforded to an employee by Statutes such as the Nigerian constitution of the Federal Republic of Nigeria 1999 as amended, the Employees Compensation Act of 2010, employees are still subject to unfair labour practices and rather than seek redress, or give up such employment they allow its continuance due to factors which include amongst others, the lack of job opportunities, high rate of poverty. The study recommends amongst others that employees be enlightened on their rights to enable them seek redress in the face of unfair labour practices. The research concludes that the workplace must be safe for workers in the exercise of their duties and measures must be taken to ensure their safety and their rights protected in the workplace as a safe workplace and protection of workers' rights is crucial for a healthy and productive work environment.
