AN EXAMINATION OF EVIDENTIAL PROOF OF MEDICAL NEGLIGENCE IN NIGERIA

Abstract

The medical profession is one of the oldest in human existence. Its relevance to the standard of living and societal development cannot be qualified. From inception, attempts have been made to retain and maintain the integrity and security of the profession, increase value of human lives (patients) and enthrone compliance culture towards ethical guidelines. Medical malpractices which are acts or omission of medical practitioners which falls short of the expectation from a professional of his status and knowledge in a given circumstances remains a major setback in the delivery of benefits of medical profession to humanity. This work addresses the challenges that have hindered the effective regulation of medical malpractice despite commendable efforts at ensuring medical practitioners stay true to the basic tenets of the profession. This study reveals that legislations enacted and bodies established in Nigeria have failed to track and rid the medical profession of unwilling, unqualified and negligent practitioners. The study deepens understanding on medical malpractices and specifically recommends prompt malpractice identification and documentation as a prerequisite for effective sanction. It further suggests a review of judicial approach towards cases of medical negligence and an amendment of relevant sections of codes and legislation for effectiveness.
