AN EXAMINATION OF THE LEGAL FRAMEWORK ON GENDER BASED VIOLENCE IN NIGERIA

Abstract

ABSTRACT This research examines the legal framework for addressing gender based violence in Nigeria. Utilizing a primarily doctrinal research methodology, it examines the various primary sources such as the Nigerian Constitution, Violence Against Persons Act, Criminal Code and Penal Code, as well as other secondary sources such as textbooks, journals, articles, newspapers, and materials from organizations such as the United Nations (UN) and relevant websites. This study finds that gender based violence is still prevalent in Nigeria despite the numerous laws against discrimination and violence currently in place. It further finds that there are various laws promoting gender violence in Nigeria, and this discriminatory system has its foundation in long cultural and legal defects. The research recommends amendments to the laws identified herein which encourage Gender Based Violence, as well as the restatement, adaptation and unification of customary laws in order to attack the causes of Gender based Violence at its roots and bring an end to the menace. In essence, this research emphasizes the imperativeness of both citizens and the government directing its focus on the protection of women as the vulnerable group in the society.
