ANALYSIS OF HUMAN RIGHTS ABUSES IN THE NIGERIAN PRISON SYSTEM

Abstract

This research work examines the duty of care and to what extent the Nigerian Prison System protect and enforce the human rights of prisoners. This is to determine the scope of duty of care and breach of human rights amongst inmate within the Nigerian Prison confines. It also states the challenges and resolutions to protecting the Human Rights of prisoners in Nigeria. It further examines the laws that can be used in protecting the breached rights of prisoners in Nigeria prison. This research, observes that the Prison system is one of the key components of Criminal Justice Administration as it�s the correctional institution where prisoners and convicts are kept after undergoing the processes of police investigation and trial by a court of law. The Constitution of the Federal Republic of Nigeria vests in the Federal Government the control and administration of prisons. This power is generally exercisable by statutory instrument of the National Assembly. However, the rights of the Prisons Act and subsidiary legislations vests in the President of Nigeria power over the control, administration, security and welfare of prisoners. It therefore concludes that this will ensure that cases of human rights abuse in the Nigerian Prison System are not treated with �medical solidarity� in trials of erring medical doctors.
