AN EXAMINATION OF THE IMPACT OF SEPERATION OF POWERS ON NATIONAL DEVELOPMENT

Abstract

This work examines the impact of separation of power as well as the extent of it�s applicability under the 1999 constitution. It also looks at the laws guiding the principle of Separation of power. The 1999 constitution makes clear provisions for the principle of Separation of power: despite the provisions of the constitution, their are several instances where one arm acts outside it�s jurisdiction thereby encroaching into the duties of another arm which is against the principles of Separation of power. This work critically examines the constitutional provisions on the doctrine of Separation of power as well as the constitutional provisions for each arm of government. The work also looks at the practice of Separation of power both at Federal level and at state level. The work further looks at the challenges facing the principle of Separation of power such as; lack of judicial independence, interference with the leadership of the legislature. This research makes certain recommendations for a better practice of the principle, autonomy of the legislature, thereby making way for the full practice of Separation of power in Nigeria.
