AN ANALYSIS OF THE LEGAL FRAMEWORK FOR RENEWABLE ENERGY IN NIGERIA

Abstract

Energy insecurity poses a major problem in Nigeria, more so than anywhere else in the world. There was a need for a pragmatic change from the use of fossil fuel to renewable energy. Change is one that is dynamic in nature and not static in the sense that the energy sector needed to evolve and renewable energy not only be introduced, but also be practiced. This research examines the legal framework for the renewable energy in Nigeria. Despite the enormous potentials for renewable energy production in Nigeria, progress in terms of development has been very slow. A number of legal, institutional, and policy constraints continue to impede the development of renewable energy investments in the country. This research makes us understand that the legal frameworks as regards renewable energy available in Nigeria are only policies and not laws. This research examines the concept of energy, fossil fuel and renewable energy as regards sources and also policies that are made available and that are set up to control renewable energy in Nigeria. This research also advocates for implementation of laws as regards renewable energy. This research recommends that the Government should ensure that the policies already in place should be more binding and enforceable, or better still, implement or adopt a law. This research concludes that there is a need for the paradigm shift from reliance on policies to the use of legislation which can be enforceable.
