Abstract

Sexual violence is a breach a person�s fundamental human rights. The rate at which it is prevalent across the world is very alarming and Kenya is no exception. Sexual violence is commonly directed at women and girls, and in recent times, men and boys have also been seen to experience it. Sexual violence is an inhuman and degrading act which leaves the victim with several physical and psychological injuries. As such, this research work examines the challenges of effective prosecution of sexual violence in Kenya. It further examines different literatures on sexual violence in Kenya and reviews the opinions of the various authors. This research work further identifies the types, causes, effects and prevalence of sexual violence in Kenya. It analyses the post rape care services in Kenya and determines its effectiveness in the prosecution of sexual violence in Kenya. This research work captures the legal framework of sexual violence in Kenya and its shortcomings. It further analyses several challenges of effectively investigating and prosecuting sexual violence in Kenya, as well as the adequacy of the punishment provided by the legislations. This research work recommends that the Kenya government should recognize sexual violence as a matter of urgency and ensure that the police and medical personnels are properly educated and equipped to handle and prosecute cases sexual violence. This research work concludes that sexual violence is a criminal offence and should not be tolerated.
