EXAMINATION OF FREEDOM OF EXPRESSION IN THE NIGERIAN CONTEXT

Abstract

This research work examines freedom of expression in the Nigerian context. It examines the scope of freedom of expression and defamation. It further examines the laws that can be used in cases of freedom of expression and defamation in Nigeria. This research adopts a doctrinal method of legal research. In the course of this research, it was observed that freedom of expression connotes the liberty of every person to openly discuss issues, hold opinions and impart ideas without restrictions, restraints or fear of punishment. It is undoubtedly, a right to be enjoyed by every person who is not under any bondage on disability. In every human society, Nigeria not being an exception, the desire and freedom of an individual to hold an opinion and share the same with a listener of his choice is a fundamental one. The study concluded that the fundamental rights of the citizens are upheld and protected at all times and are not whittled down except by the exceptions and provisions clearly enacted or identified in the Constitution itself or in existing statutes or regulations which are not in conflict with the Constitution. The research recommends that Federal and State Governments should collaborate with Nongovernmental organizations to create an awareness campaign to enlighten the citizens on defamation law and make them understand that in as much as they have the right to freedom of expression, they should not exceed such right to the detriment of the reputation of others. The awareness campaign should educate the people that when they are defamed, the law has granted them the right to institute actions in court for the protection of their reputation through award of damages, and other remedies.
