SURROGACY IN NIGERIA: THE NEED FOR A LEGAL FRAMEWORK

Abstract

� Surrogacy is a complex and controversial issue that raises numerous legal, ethical, and social questions. In Nigeria, there is currently no specific legal framework governing surrogacy arrangements leading to uncertainty and potential exploitation of all parties involved. This� project examines the need for a comprehensive legal framework for surrogacy in Nigeria, considering the rights and protections of surrogate mothers, intended parents, and children born through surrogacy. The absence of clear statutory provisions leaves intended parents, surrogate mothers, and children born through surrogacy in a legal vacuum, lacking protection and clarity regarding their rights and obligations. This research analyzes the socio-cultural, ethical, and legal dimensions surrounding surrogacy, analyzing existing international and regional legal frameworks to propose suitable adaptations for Nigerian law.Key considerations include the protection of surrogate mothers from exploitation, ensuring informed consent throughout the process, and safeguarding the rights of children born through surrogacy to legal recognition and familial stability. The findings show that there exists current gaps in Nigerian law regarding surrogacy and proposes a draft legislative framework that aligns with international human rights standards and national values. The research recommends the enactment of a comprehensive legal framework stating its legal enforceability, �legal parentage for children born through surrogacy arrangements, consent requirements, eligibility criteria for surrogacy agreements, dispute resolution mechanisms, and public awareness and enlightenment regarding surrogacy as a form of Assisted Reproductive Technology. �In conclusion, a comprehensive legal framework for surrogacy will regulate surrogacy agreements as well as prevent abuse and exploitation of all parties involved in surrogacy agreements.����� � �����������
