EXAMINING THE LEGAL IMPLICATIONS OF CORPORAL PUNISHMENT ON CHILDREN IN NIGERIA

Abstract

Corporal punishment also known as physical punishment or in some instances termed as physical abuse is the use of force that is inflicted on the body of a person as a means of correction. This research examines the incidences of corporal punishment that led to grave outcomes on children in Nigeria and the need for implementing legislations that properly addresses this sensitive global issue. This research examines the provisions of corporal punishment under international covenants, statutes and Nigerian legislative law. This research shows that there are not expressly stated provisions within Nigerian statutes that applies to corporal punishment. However, there are several international statutes that Nigeria have ratified that prohibit this act. This research sheds light into the drastic consequences that has arose from severe forms of corporal punishment on children especially in schools. This research also advocates for other effective means of discipline that can be applied on children. This research recommends alternative forms of punishment that have been proven to be very effective in child discipline. The Criminal Code, Penal Code and other necessary relevant laws must be amended to include sections that recognizes corporal punishment as a form of violence on children and its excessive abuse should in turn be criminalized.
