EXAMINING ALTERNATIVE DISPUTE RESOLUTION AS AN EFFECTIVE STRATEGY FOR RESOLVING DISPUTE IN NIGERIA AND OTHER SELECTED JURISDICTIONS.

Abstract

Various means have emerged through which disputes are resolved, most prominent of which is the traditional or formal method known in common parlance as Litigation. Litigation though laudable and far-reaching in effect, is not without its attendant insurmountable problems which principally are that of undue technicality, high cost implication, inflexibility etc. The summation of these challenges indirectly defeat the cause Litigation is meant to serve i.e. see to proper tackling of differences between or among contending parties in the best way possible. The need to therefore ensure social justice in a way that is better, quicker and more socially acceptable has resulted in the evolution of a global trend in justice administration and accessibility known as alternative dispute resolution. �In every basic level of human interaction, there is invariably bound to be disputes or differences ensuing over inexhaustible number of issues especially in the society. This research work identifies the characteristics, advantages and disadvantages of this dispute resolution method, in relation to strategy for effective dispute resolution. This research work also examines these adjudication methods in some selected jurisdictions. It further analyzes the development and practice of ADR in Nigeriaand also ADR process in Nigeria, with a view of how ADR is a better approach, to resolve disputes. This research work was carried out with the aid of textbooks, manuals, journals, and the internet.
