A CRITICAL APPRAISAL OF THE LEGAL FRAMEWORK FOR THE PROTECTION OF WOMEN AGAINST DISCRIMINATORY PRACTICES IN NIGERIA

Abstract

This research work critically appraises the legal framework for the protection of women against discriminatory practices in Nigeria. The issue of discrimination against women in Nigeria is as old as history and� has remained same� basically because of respect for tradition and custom by various ethnic nationalities in Nigeria, However� with pressure from international organization like united nations, African union� some reforms have taken place� in this regard. This research examines the effect of discriminatory practices against women in Nigeria. It analyses judicial response to human rights of women in Nigeria and examines the rights of women as provided in the CEDAW, other international instruments as well as the constitution and other local laws protecting women�s right in Nigeria. It observes that governmental structures exist for the advancement of women.� However, the problem lies in the implementation. Based on the findings, this research recommends that the national assembly should take steps to incorporate international treaties that Nigeria has ratified into our legal system to enhance enforceability. This work concludes that one of the major challenges for the protection of women against discriminatory practices in Nigeria is the lack of domestication.�
