Abstract

This research examines the duty of care of an employer to his employee in Nigeria. The research adopts the doctrinal research method and reviews primary and secondary sources such as the Nigerian Constitution, the Labour Act, the Factories Act, etc and finds that an employee can institute an action against an employer for breach of duty of care where the environment in which the employee is to work is not habitable to carry out his job functions. The research recommends that employers must align with international best practices and government must put in measures to establish sufficient checks and safeguards against employer abuse and exploitation. The research concludes that employees can only be productive if their work environment is hazardous free and habitable
