SANCTIONS AND REMEDIES FOR BREACH OF ENVIRONMENTAL LAW IN THE NIGERIA PETROLEUM SECTOR
Abstract
One of the recurring problems faced in Nigeria is environmental pollution, particularly from oil spillage. However, there are numerous legislation, at both national and international level, for the regulation of environmental pollution. Even with the various existing regulations, oil spillage continues to destroy lives in Nigeria. Where oil spillage occurs, the remedies available have their inherent technicalities from the beginning of the spillage. For instance, the victim of the spillage, whether individual or community find themselves in an uncertain situation regarding the appropriate court to approach and when that is done, there is the problem of whether to seek remedy in a civil action or file criminal charges. The question of proof of evidence greatly affects the issue of award by way of remedies and this greatly influence the effectiveness of remedies awarded by the court. This project would examine some of the legislation governing environmental pollution in relation to oil spillage. It will also examine case studies of oil spillage and the remedies that were awarded. These include how the remedies awarded affect both victims and the perpetrators. In conclusion, this research would recommend solutions to the problems of oil spillage and how to make remedies effective with a view to preventing Oil Companies from further spillage .
