Abstract

This study examines the basic indices of customary law marriage in the Nigerian Society as well as the solemnization of holy matrimony which is usually done according to the Matrimonial Causes Act. This study employs the doctrinal methodology and explores existing Legislations, Academic materials, Case Laws and Internet Sources with a view to providing a concise overview of the intricacies and dynamics surrounding customary law marriages in Nigeria and the practice of Double Decker Marriage. This research highlights the lack of awareness about the legal implications of double-decker marriage, leading to confusion and challenges for couples, lack of clarification of the legal status of customary law in Nigeria and the conflicting legal frameworks governing customary and statutory marriages in Nigeria, resulting in controversies and challenges. The findings reveals there is a need for legal reform to address the challenges and controversies associated with double-decker marriage in Nigeria. This study underscores the importance of legal reform to address the challenges and controversies associated with double-decker marriage, including the introduction of bye-laws to regulate customary marriage proceedings and the amendment of the Marriage Act to clarify the status of earlier customary marriages in double-decker marriages. By addressing this limitations it will promote congenial harmony to Nigerian families which are seen as the very foundation of our existence as a nation. �
