AN APPRAISAL ON THE USE OF ALTERNATIVE DISPUTE RESOLUTION MECHANISMS TO RESOLVE MARITAL DISPUTES IN NIGERIA

Abstract

It is an acknowledged fact of human existence that disputes are perennial and disperses energy, time and finances, whereas amity is the foundation for progress and development. Nigeria is one of the countries in the world where the adversary system of civil Justice is practiced. This adversarial court based approach sometimes results in acrimony and frustration due to inordinate delays. Alternative dispute resolution(ADR) mechanisms is referred to as an easy means of settling marital disputes as well as other disputes out of the normal court processes. The use of ADR mechanisms has been thriving well in the areas of shortcomings of litigation. This research explores the various methods of Alternative Dispute Resolution that can be harnessed in resolving matrimonial causes in Nigeria. It also points out the benefits and challenges in using ADR mechanisms in resolving marital disputes, it recommends that Parties before choosing any of the ADR mechanisms must think of which they prefer before venturing into it and also a greater awareness should be made about the use of ADR in Nigeria. This research concludes that the legislative organ of government should develop a new legislation on resolution of matrimonial causes where ADR will be given more recognition. �
